België veroordeeld wegens doorsturen asielzoeker

Op 21 januari 2011 heeft het Europese Hof voor de Rechten van de Mens België veroordeeld omdat het een asielzoeker naar Griekenland doorverwees. Het arrest laat niet langer toe om asielzoekers door te verwijzen naar Griekenland. Ook Nederland, Duitsland en Zweden zijn gestopt met die doorverwijzingen.

De Belgische staat moet de man 24.900 euro morele schadevergoeding betalen, plus 7.350 euro voor onkosten. U kunt hier het arrest vinden.

In 2009 vroeg de Afghaanse M.S.S. asiel aan in ons land omdat hij in zijn thuisland naar werd bedreigd door de Taliban. Hij was er tolk voor de Isaf-troepenmacht. Tijdens het onderzoek ontdekte de Dienst Vreemdelingenzaken dat hij de Europese Unie was binnengekomen via Griekenland. Volgens de Dienst Vreemdelingenzaken is het in de EU de normale gang van zaken dat het land waarlangs een asielzoeker binnenkomt de aanvraag verwerkt. De zogeheten ‘Dublin II-conventie' regelt dat.

Bij de Dienst Vreemdelingenzaken was er blijkbaar niemand op de hoogte van de nochtans indrukwekkende hoeveelheid rapporten en jurisprudentie.
